Terms of service
Last updated: [to fill: date]
These terms are an agreement between you (the customer) and [to fill: company name] Pte. Ltd., a company registered in Singapore (UEN [to fill]), of [to fill: registered address] ("we", "us"). They cover your use of the Gako service at [to fill: domain] (the "service"). By creating an account you agree to them, to our privacy policy and to our acceptable use policy. If you sign up for a company, you confirm you may bind it.
1. What the service does
The service helps you write to businesses you choose. From your brief it finds companies and people, scores how well they fit, drafts emails and follow-ups, sends them from mailboxes you connect (or, after your first top-up, from mailboxes we provide), reads replies and drafts answers. You choose how much it does on its own: autopilot, or approving emails before they go.
2. You are the sender
- Every email the service sends is sent by you, on your behalf, in your name. You are responsible for the campaigns you run, the people you choose to reach, what your emails say and offer, and for following the law that applies to each email (for example the US CAN-SPAM Act, Canada's CASL, the UK's PECR, the EU's ePrivacy rules and GDPR, Australia's Spam Act and Singapore's Spam Control Act).
- The service applies some country rules for you: it holds or refuses emails to countries that need consent (and to countries whose rules we have not checked), unless you take on the risk for that country as below. It adds a way to say no to every email, stops at once when someone does, and checks a do-not-contact list before each send. These checks help; they are not legal advice and do not make your sending lawful.
- Sending on your own risk. Where the service warns that a country's law may not allow an email, you may still choose to send there by ticking the warning for that country. By doing so you confirm that you have checked you may lawfully send there (for example that you have consent, or another basis the law accepts), that you are the sender of those emails, that you accept the risk of any fine, claim or complaint that follows, and that the indemnity in section 13 covers it. These emails may go from your own mailboxes or from mailboxes we provide. We keep a record of who accepted, when, and the words they accepted. You can withdraw by writing to us. [for a lawyer: check this holds, in particular for the EU, Germany's UWG and Australia's s 16(9), and for sending from our mailboxes]
- Settings are your choice. For example, whether to put
<ADV>at the start of a subject line (asked for by Singapore's Spam Control Act for unsolicited bulk email) is a campaign setting, off by default; turning it on where the law needs it is up to you. - You give us true details for your sender name, company and postal address, and keep them up to date.
3. Your lists and your leads
- You are responsible for any list, address or lead you bring, and for having the right to use it.
- Leads the service finds come from business data providers and from companies' own public websites. We do not scrape LinkedIn, and you may not use the service with data scraped from LinkedIn or any site whose terms forbid it.
- For personal data about the people you write to, you are the controller and we process it for you, as our privacy policy describes. [for a lawyer: a data processing agreement for customers in the EU and UK is not drafted yet; needed before selling there]
4. Data from our providers
Some of the company and people data in the service comes from third-party providers (for example People Data Labs). They allow it to be shown to you inside the service on conditions we must pass on to you. So, for any lead data the service gives you:
- Use it only for your own business-to-business outreach through the service.
- Do not sell, rent, share or publish it, or give it to anyone outside your company.
- Do not export it to build or add to a database, a list for sale, or a product that competes with the service or with the provider.
- Do not use it to decide anyone's eligibility for credit, insurance, employment, housing or any other purpose covered by the US Fair Credit Reporting Act or similar laws.
- Do not use it to harass, track or discriminate against anyone, or in any way the law forbids.
- Data you export (for example a CSV of your leads) stays under these conditions.
A provider may change its conditions or stop supplying data; we will update this section when that happens. If you break these conditions, we may stop your access to lead data or close your account. [for a lawyer: check this list against People Data Labs' Services Subscription Agreement (6 Aug 2026), section 2.2.1 and its restrictions, and against each other provider the service uses before launch]
5. Your account
- You need a work email to get the free trial. One trial per company.
- Keep your password safe. You are responsible for what happens under your account.
- A new account's first campaign is checked by us before anything sends, and each account has a daily sending ceiling that grows with clean sending. We set these to protect deliverability for every customer; you cannot raise them yourself.
6. Mailboxes you connect
When you connect a mailbox, you allow the service to send email from it and to read its inbox for replies to emails the service sent. During the trial it also reads how much mail your Sent folder holds from more than 30 days ago, to check the address is one you already use; it does not read or keep that mail. Mailbox passwords and tokens are stored encrypted and used for nothing else. You can pause or remove a mailbox at any time.
7. The free trial
- New accounts with a work email get US$15 of trial credit, with no card. One trial per company.
- The trial credit lasts 14 days from sign-up. Whatever is unspent then ends. It has no cash value and cannot be refunded or moved.
- During the trial, emails go from an address you already use every day, on your company's own domain, up to 30 emails a day, and, once they are open, from our shared warmed mailboxes, up to 50 a day more. Replies to our mailboxes are forwarded to you. The trial sends to one audience, and each firm gets the first email and one follow-up.
- Any top-up ends the trial's limits. The trial credit still ends 14 days after sign-up; what you paid stays.
8. Prices and payment
- Pay as you go: there is no subscription. You add credit, and each outreach email costs US$0.04 when it is sent, or US$0.03 for 30 days after a top-up of US$300 or more. Answers to replies are not charged. An email that fails to send is refunded to your balance.
- You add credit by top-up; auto top-up is off until you turn it on, and then adds the amount you set when your balance runs low, never above your monthly cap. You can remove your saved card on Billing at any time; auto top-up then turns off.
- Each workspace includes 3 projects; each project after that costs US$9 every 30 days from your balance, taken when you add it and every 30 days after, until you remove it. Days already paid are not refunded. Payments are handled by [to fill: Paddle.com, as merchant of record], whose terms also apply to your purchase.
- Prices are shown before you pay and may change with [to fill: 30] days' notice; credit already bought keeps the price it was bought at [to fill: confirm].
- Refunds of unused paid credit: [to fill: policy, e.g. within 14 days of purchase if unused]. [for a lawyer: check against Paddle's refund rules and consumer law where we sell]
9. How we improve the service
We record how emails do (the audience, the angle, the subject style, the length, the step, the send time, the recipient's country, industry and company size, and whether it bounced, got a reply, what kind, or led to a meeting), and how the service is used (which steps and screens, where people stop). We pool these numbers across customers to make the defaults, the writing and the set-up better for everyone.
What is pooled is features and outcomes only: never names, email addresses, company names or the text of any email or reply. Nothing pooled can show another customer who you wrote to or what you said. We do not sell it. [for a lawyer: check that this is enough to treat the pooled data as not personal data under the PDPA and GDPR]
10. What you may not do
You must follow the acceptable use policy. We may pause sending, a campaign or an account at once if we reasonably believe it breaks that policy or the law, or puts other customers' sending at risk, and we will tell you why.
11. Our service
- We aim to keep the service running but do not promise it will be uninterrupted or error-free.
- The service uses AI to draft emails, score leads and sort replies. AI can be wrong. Check what you approve, and choose approval modes if you want to see emails before they go.
- We do not promise any number of replies, meetings or sales, or that emails will reach inboxes.
12. Ownership
You keep all rights in your content: your profile, briefs, emails and lists. You let us use it only to run the service for you, and to make the pooled numbers in section 9. We keep all rights in the service itself. If you send us suggestions, we may use them freely.
13. Liability
- To the extent the law allows, the service is provided "as is", and our total liability to you for any claim is limited to the amount you paid us in the [to fill: 12] months before the claim.
- We are not liable for indirect or consequential losses, lost profits, or lost data, to the extent the law allows.
- You will indemnify us against claims from third parties arising from your emails, your lists, your use of provider data, or your breach of these terms or of the law. [for a lawyer: check scope and that it holds for customers in the US, UK and EU]
14. Ending
You can close your account at any time. We may end these terms with [to fill: 30] days' notice, or at once for a serious breach. You close it on Billing: sending stops at once, and for 30 days you can log in and reopen it; then we delete your data as our privacy policy says. Unspent paid credit (not trial credit) is refunded if you ask us at lin@getgako.com within 30 days of closing. [for a lawyer: check]
15. Changes
We may update these terms. For material changes we will email you [to fill: 14] days before they take effect.
16. Law and disputes
These terms are governed by the laws of [to fill: Singapore]. Disputes go to [to fill: the courts of Singapore / arbitration at SIAC]. [for a lawyer: choose]
17. Contact
[to fill: legal or support email], [to fill: registered address].
